Spouses who are filing for divorce will have to deal with numerous pressing issues, like the division of their property.  Property refers to things like spouses’ homes, cars, savings, material assets and also debts. 

In the state of Texas, property division will be decided upon one of two ways.  First, property division may be mutually agreed upon by spouses.   In this type of situation, spouses would sign a Marital Settlement Agreement which would specify how property is to be divided.  Second, in cases where spouses cannot reach a mutual decision regarding the division of their property, the district court where their cases was filed would decide upon how their property is to be divided.  A judge would issue a property division order and the judge’s order would be included in the Decree of Divorce.

Property is divided differently in each state.  The state of Texas is a community property state, which means that all possessions, money and debts incurred from the beginning of the marriage till the end of the marriage will be split equally in cases where spouses cannot reach a mutual agreement.  However, any property that was acquired outside of the marriage, such as an inheritance, will be regarded as separate property and will not be counted as community property.  This means that the rightful owner of the separate property will remain in possession of the property.
