The Texas divorce process commences when one spouse files a Petition for Divorce in their county’s District court. Once the Petition for Divorce is filed by one spouse, his/her spouse will receive a copy of the Petition and he/she will also receive a citation. The Petition and citation may be delivered by the spouse filing for divorce, but is more commonly delivered by a Sheriff, Constable or a private delivery processor. The divorce case will then be assigned to a court that handles family law matters.
The rest of the divorce process will largely depend on whether the divorce is contested or uncontested. During an uncontested divorce, the couple will have reached an agreement on all important issues and will not need much intervention from the court. These divorces tend to be faster and less strenuous in the long run. If the divorce is contested, the courts will have to intervene and decide upon important issues like child custody, child support, spousal support and property division. A judge will have to make these decisions for the spouses and will make choices in accordance with Texas state laws.
Once important decisions have been made by the spouses or by the judge presiding over the case, the divorce will be finalized by the district court. At that time, the marriage will be terminated legally and spouses will no longer be considered married.
